What is the CHOOSE Act in Alabama?

Governor Kay Ivey signed the Creating Hope and Opportunity for Our Students’ Education (CHOOSE) Act into law on March 7, 2024. This act created education savings accounts (ESAs) to support K-12 students in Alabama.

Managed by the Alabama Department of Revenue, the program provides financial assistance to families at approved service providers.

Eligible students enrolled in participating schools can receive up to $7,000, while those in home education programs are awarded up to $2,000 per student. For homeschooled students, Alabama families can accept a maximum of $4,000 per family.

Homeschool students may use their ESA funding for tuition, fees, and other qualified educational expenses from the list of education service providers, provided by the CHOOSE Act.

Who Qualifies for Alabama CHOOSE?

To apply for Alabama’s CHOOSE Act ESA for the 2025-2026 school year, eligible families must:

  • Provide proof of Alabama residency
  • Have a student in grades K-12
  • Provide proof that their household income does not exceed 300% of the federal poverty level for the 2024-2025 tax year

The first 500 ESAs will be awarded to students with special needs, followed by dependents of active-duty service members enrolled in priority schools and siblings of participating students.

You can find a list of the Alabama CHOOSE Act’s participating schools by clicking the link or visiting the Alabama Department of Revenue.

Please note that if your student is currently receiving a scholarship under the Alabama Accountability Act for the 2025-2026 school year, they will not be eligible to receive the CHOOSE ESA for the same period. In the future, you can apply to both programs but may only accept assistance from one.
